Dans cette session, nous discuterons des implications juridiques et commerciales de la nouvelle « Repeal Bill » ou « European Union (Withdrawal) Bill » qui sera adoptée par un vote final le 21 septembre 2017.

«C'est l'une des lois les plus importantes qui a été adoptée par le Parlement et constitue une étape majeure dans le processus de retrait de l'Union européenne» - David Davis, secrétaire d'État au Département de la sortie de l'Union européenne, annonçant la loi d'abrogation.

Cette loi vise deux objectifs en apparence contradictoires: rompre avec l’Union européenne et transposer la législation européenne dans le droit interne britannique. Le texte abroge ainsi la loi de 1972 (European Communities Act 1972) qui prévoyait l’incorporation automatique des textes communautaires dans le droit national. Il s’agit de mettre fin à la «suprématie de la loi européenne».

In this session we will discuss the legal and commercial implications of the new "Repeal Bill" or "European Union (Withdrawal) Bill" which will be adopted on a final vote on September 21, 2017. "This is one of the most important laws that has been adopted by Parliament and constitutes a major step in the process of withdrawal from the European Union" - David Davis, Secretary of State for the Department of Exit European Union, stated announcing the repeal law. This law has two seemingly contradictory objectives: breaking with the European Union on one side and transposing European legislation into British domestic law, on the other side. The bill repeals the 1972 law which provided for the automatic incorporation of Community law into national law. The stated objective is to put an end to the "supremacy of European law".
