Clive's expertise

 Partnership & LLP

I have a particular expertise in handling high value and sensitive LLP/partnership disputes for firms and individuals and have been ranked as a Leading Individual for contentious work by Chambers & Partners UK.  The work I do in this area includes representation of clients in relation to voluntary and compulsory retirements, expulsions, team moves, performance issues, restrictive covenants, reward and remuneration disputes and secret profit claims.  I also advise management committees and managing partners on confidential internal issues in professional service firms.

I have written for professional trade publications in various sectors and was co-author of ‘Employment Partnership and Discrimination Law for Professional Partnerships’ (published by Legalease 2005).

 Dispute Resolution

My litigation and dispute resolution practice consists primarily of advising corporate clients and high net worth individuals on a range of complex and high value commercial disputes including contract and negligence claims, breach of warranty, misrepresentation, commercial fraud and fiduciary duties.

While I will seek to devise strategies at an early stage to try and prevent “disagreements” escalating into “major disputes, when disputes can’t be avoided I have experience of the whole range of dispute resolution tactics to achieve results.  I deal with disputes at all levels and in all divisions of the Courts and have considerable experience of bringing, and defending, applications for injunctive remedies and other interlocutory relief.

 Law Firms & Professional Services

My work for businesses and individuals in the professional services sector includes not only LLP/partnership disputes and regulatory investigations but, also encompasses advising in relation to disputes with third parties.  The clients I act for operate in a variety of areas including the legal sector, accountancy, financial services, property professionals, architects and surveyors, health care professionals and veterinary practices.

 Commercial Litigation

I have many years experience advising both claimants and defendants in complex and high value commercial disputes.  During my career, I have conducted trials in both the High Court and the County Court, appeared before the Court of Appeal, conducted international and domestic arbitrations and, where appropriate, employed a range of alternative dispute resolution techniques including mediation and negotiation. The clients I have represented operate in a wide range of economic sectors and conduct business as public companies, private companies, limited liability partnerships and traditional partnerships.  I also represent high-net worth individuals in commercial litigation matters.

 Arbitration

I act in commercial disputes in both domestic and international arbitrations, conducted under the rules of well known institutions, such as the London Court of International Arbitration and the International Chamber of Commerce, and on the terms of ad hoc arbitrations arising from commercial agreements.  In addition to representing clients in the arbitration process to the conclusion of a hearing and the handing down of an award, I have also challenged the jurisdiction of arbitrators, opposed the enforceability of purported arbitration clauses and applied to the High Court to compel the operation of domestic arbitration agreements and the stay Court proceedings.
