James's expertise

 Brand Management

I advise a variety of advertising and marketing agencies on digital, social and traditional media campaigns. My role includes drafting and negotiating client and agency agreements, supplier agreements, advising on the legality and practicality of campaigns, copy clearance and drafting standard terms. I have a detailed knowledge of the advertising self-regulatory system, having been a member of the Committee of Advertising Practice for a number of years. During that time I was involved in the negotiations that led to the extension of the Advertising Standards Authority's digital remit to cover social media marketing and companies' own websites.

 Publishing

Before joining Lewis Silkin I was Head of Legal at the Professional Publishers Association (PPA) - the industry body that represents the magazine media industry. During that time the industry shifted from being print publishers with relatively small digital operations, to platform agnostic publishers.

I continue to work with the PPA, the Association of Online Publishers and the Association of Publishing Agencies - as well as individual publishers - in my current role.

 Technology & Digital

I am part of the technology group and have recently been advising advertising agencies on innovative campaigns involving the delivery of software and other technology.

I have closely followed the policy debates around copyright for a number of years, including the recent Hargreaves Review, and the potential and actual impact on developing business models of changes. I was a founding member of the Confederation of British Industry's Intellectual Property Committee and have sat on various industry bodies looking at the impact and opportunities of new technology.

 Consumer Regulation

I am very familiar with the UK's regulatory landscape as it applies to media and marketing. I was a member of the Committee of Advertising Practice for a number of years, acting as the magazine media industry's representative. I was also involved in negotiations that led to the formation of the Authority for Television on Demand and I am familiar with its code.

In my role at Lewis Silkin I advise on various consumer and regulatory matters, including advertising clearance, the new 'cookie' legislation and data protection compliance.

 Commercial

I draft and negotiate a wide range of commercial contracts, including in the media, advertising and marketing sectors. Those range from basic confidentiality agreements to bespoke services contracts that involve complex deliverables.
