 Dispute Resolution

I help clients resolve a wide range of commercial disputes whether through negotiated settlement, court or arbitration proceedings. I also advise on how to avoid disputes arising in the first place by giving advice on potential liabilities and risks.

I have experience of dealing with claims in various forums, including not only the courts, but also arbitral panels and the Pensions Ombudsman.

If disputes cannot be prevented though, mediation is one option available to resolve the dispute. For many clients mediation can bring about an early and cost-effective resolution to their dispute.  I have been involved in a number of mediations where a settlement has been reached on the day or shortly thereafter based upon progress made at the mediation.  Careful consideration needs to be given as to the correct time to mediate, agreeing the right mediator and being properly prepared for the day. 

 Commercial Litigation

I have experience of dealing with claims in the various divisions of the High Court as well as the County Courts, ranging from lower value to multi-million pound claims.  Recent cases include:

  • Acting for a major retail corporation in proceedings for a declaration concerning the interpretation of certain provisions of a complex relationship agreement;
  • Claims relating to unpaid consultancy fees against a major investment bank;
  • Acting for both individual and corporate claimants in claims for unpaid fees from a hedge fund;
  • Acting for a large utilities company in respect of unpaid fees, involving the interpretation of a key provision relating to the liability of joint occupiers.

 Banking Disputes

I act both for and against banks and other financial services institutions. I have experience of acting against major investment banks, private banks and hedge funds in high value claims in relation to mis-selling, claims in unjust enrichment and claims under consultancy agreements and guarantees. I have also advised banks in relation to claims in dishonest receipt and knowing assistance and freezing injunctions.
