As Hong Kong continues through the fourth of the COVID-19 pandemic, the government has imposed more stringent measures in an attempt to contain the spread of the virus.

One of these measures is the sudden lockdown of neighbourhoods for mandatory COVID-19 testing, where residents are not permitted to leave their neighbourhood until they have all been tested for COVID-19. Meanwhile, vaccinations against COVID-19 are expected to roll out in Hong Kong shortly, and some employers are eager to have their employees vaccinated to ensure the safety of the workplace.

In this session, our Hong Kong team will cover the following key considerations for employers:

  • Can employers deduct employees’ wages or annual leave for absence from work due to a sudden government-imposed lockdown?
  • How should employees’ absence be treated in this situation?
  • Can employers dismiss employees for failing to attend work in the circumstances?

In relation to the upcoming COVID-19 vaccinations roll-out:

  • Can employers mandate employees to be vaccinated?
  • How should time out of work to take the vaccination be treated?
  • Can an employee be disciplined or terminated for refusing to be vaccinated?
  • Can an employer require that employees disclose whether they have been tested for and/or vaccinated against COVID-19
  • Can the employer require employees to disclose the results of a COVID-19 test?
