In this session we’ll cover the latest developments in relation to the Trans-Atlantic Data Privacy Framework (it’s finally here!) and touch on some developments at a pan-European level affecting online advertising and the ad-tech industry.

After more than a year since the first announcement of the Trans-Atlantic Data Privacy Framework, the European Commission adopted its adequacy decision on the EU-US Data Privacy Framework (DPF) on 10 July 2023. You can read our article here. In this session, Alexander Milner-Smith will run through the market reaction and the practical steps your business may want to consider.

Bryony Long and Mark Hersey will also be discussing some recent trends affecting the online advertising industry (but which will be of general interest for all controllers) including:

  • a decision by the CJEU on the lawful basis that can be relied on for online behavioural advertising and the use of special category data.
  • a fine issued by the French supervisory authority, the CNIL, on an ad-tech vendor’s reliance on so-called ‘contractual consent’ for targeted advertising.
