Making litigation affordable: Funding options and their relevance to you

You may have heard about conditional fee agreements, after the event insurance and third party funding, but do you understand enough about them and how they may assist you in funding disputes which you become involved in?

This session will explain what you need to know about the rapid developments in this area over the last year, culminating in the publication in January of Lord Justice Jackson's review of Civil Litigation Costs and the Government's current consultation on costs in libel cases. It will make clear what these developments mean for those involved in all types of dispute as claimants or defendants, with a particular focus on media and intellectual property claims.

The briefing will cover:

  • an explanation of conditional fee agreements and how they might work for you
  • insurance options, including before and after the event insurance
  • third party funding of disputes, and when it might be relevant
  • how the landscape may change after the Jackson Report and Government consultation
  • specific funding issues in media and IP disputes.

We are delighted to welcome Matthew Amey from The Judge (expert litigation insurance brokers), who will explain what insurers and funders look for when considering whether to cover costs or fund a claim.

Sohrab Daneshku, Litigation Associate, will outline the main legal issues which commonly arise in these type of situations. Giles Crown, Head of Media, Brands and Technology will also discuss the implications for those involved in media and intellectual property dispute.
