Lewis Silkin has been invited to respond to the BCAP Consultation by the ASA. The consultation closes on the 19th June and Lewis Silkin will also be submitting a paper detailing suggestions for reforms to the current ASA appeals process.
Brinsley Dresden, Partner and Head of Advertising and Marketing law at Lewis Silkin is leading the firm's call for reform saying:
" For advertisers who find themselves on the end of an upheld complaint the consequences are severe. Whilst the current system serves many advertisers well we believe there is still room for improvement.
There should be a better process in place to help achieve consistency in the clearance process and offer advertisers the right to appeal against a decision.
This is the right time to propose changes to the system and we will be making our submission at the request of the ASA prior to the close of the consultation period on 19th June"
