I have extensive experience of acting for both commercial clients and high net worth individuals in contractual disputes, breach of trust/fiduciary duty claims, boardroom and shareholder disputes, professional negligence and fraud. In addition to court proceedings, I am also experienced in conducting arbitrations, both international and domestic, including ad hoc arbitrations under the Arbitration Act 1996 as well as arbitrations pursuant to the rules of the International Chamber of Commerce and the London Court of International Arbitration. I have also conducted numerous mediations.
I contributed the chapter on “Retirement” in Employment, Partnership and Discrimination Law for Professional Partnerships (Legalease; 2005) and the chapter on “Whether and When to Mediate: Tactics and the Law” in ADR Client Strategies in the UK (Aspatore; 2008) and have been published in the Law Society Gazette, the Lawyer, the New Law Journal, In-House Lawyer and Corporate UK.
I have contributed to two Legal Network Television programmes on conflicts of interest and solicitors’ professional rules.
Acting for the purchaser of a private company in a breach of warranty/misrepresentation claim against the seller relating to failure to disclose the true financial position of the company at the time of purchase.
Acting for a minority shareholder in a petition for unfair prejudice brought under section 459 of the Companies Act 1985 (now section 994 of the Companies Act 2006) in a claim involving diversion of business assets and opportunities to a competitor.
Acting for a large UK retailer in an international arbitration with a US company arising out of a contractual dispute subject to English law, culminating in a two-week trial before a panel of three arbitrators under the LCIA Rules.
Acting for a professional trustee in a claim for breach of trust brought by a beneficiary/co-trustee, also involving freezing injunctions.
Acting for a supplier of software and IT infrastructure services in High Court proceedings against a major international airline relating to unpaid fees and breach of contract arising out of a global contract for the upgrade of IT infrastructure services.
Acting for a US based multi-national computer games publisher in a contractual dispute with its former Italian distributor in an ICC arbitration based in London before a three member international arbitration tribunal.
I have acted for retailers, pharmaceutical companies, IT companies, partnerships, both corporate and individual shareholders/directors, high net worth individuals and many more. These have included Harrods, EFG Bank Group, House of Fraser, Dexcel Pharma and GE Capital IT Solutions.
