On 4 June 2021 the European Commission published the new EU Standard Contractual Clauses (SCCs) and they appeared in the Official Journal on 7 June 2021.

On 4 June 2021 the European Commission published the new EU Standard Contractual Clauses (SCCs) and they appeared in the Official Journal on 7 June 2021. 

With a potential 18 month transition period from 27 June 2021 (initial 3 month transition whilst old SCCs can still be entered into followed by 15 month status quo transition) some are asking what all the fuss is about, and what, if anything, they should be doing now, as if the last year or so has taught us anything it is that 18 months feels like a long time! 

The answer of course will depend on what your plans are in the coming months, where you got to in the last 11 months with your Schrems ii work, as well as whether you work in an organisation that takes the “better the devil you know” rather than the “rip the plaster off now” approach. There is no one-size fits all, and it will take some thought to determine the best strategy for your organisation, particularly as, amongst other things, we are as yet to see what the UK SCCs will say and what Switzerland plans to do about the new EU SCCs.
