The Data Protection (Charges and Information) Amendment Regulations 2025 (see here) were laid before parliament on 27 January 2025, following a government consultation regarding an increase in the fee payable by controllers to the ICO. The fee payable to the ICO was last increased in 2018.

The current position

The fee payable to the ICO currently falls within 3 tiers as follows:

  • Tier 1 – micro organisations (£40)
  • Tier 2 – small and medium organisations (£60)
  • Tier 3 – large organisations (£2,900)

The tier which applies depends on the turnover and number of staff of the controller (see here for details).

The fee increase

The consultation suggested fee increases for tier 1 (£55), tier 2 (£82) and Tier 3 (£3,979). However, the fee increase in the Regulations laid before parliament were slightly lower than that. The new fees, which maintain the same tier structure, are as follows:

  • Tier 1 - £52
  • Tier 2 - £78
  • Tier 3 - £3,763

The Regulations will come into force on 17 February 2025. It may be useful for Tier 3 organisations in particular who are approaching their renewal date to consider renewing early, before the fee increase.
