With the introduction of new powers under the Digital Markets, Competition and Consumers Act, the Competition and Markets Authority now has the power to impose penalties directly, without having to go to court, with fines of up to 10% of global turnover. The CMA's new Enforcement Guidelines also state that an upheld Advertising Standards Authority complaint will be one of the possible triggers for their enforcement action, so it is even more important than ever to successfully defend an ASA investigation.
