Collective agreements and TUPE - more dynamic than you might think

In Beerg's Global Labor newsletter, Katherine Shaw discusses the transfer of employees to another employer under TUPE.

Usually, one's terms and conditions are transferred along with any collective agreements that applied, but in certain circumstances this may differ. Katherine goes on to discuss whether the new employers are bound by later changes to a collective agreement to which they are not even a party.

The Transfer of Undertakings (Protection of Employment) Regulations 2006 and previous versions of the regulations (which have been in force in the UK since 1981) implement the European Acquired Rights Directive, the general purpose of which is to safeguard employee rights in the transfer of a business.
