Managing restructuring and redundancies successfully is complex, but crucial. 

Providing support through processes which can be emotionally difficult as well as commercially disruptive, we partner with you to devise, implement and manage restructuring exercises, including those involving changes to terms and conditions. 

Our expertise includes supporting redundancy programmes ranging in scale from large and multi-jurisdictional to smaller groups and individuals.

We’ll work with you to devise and implement your redundancy and/or restructuring strategy, including changes to terms and conditions, redundancies, multi-jurisdictional programmes and individual, specialist requirements. We can also advise on employment tribunal claims and litigation – whether brought by employees or collectively by their representatives.

Collective redundancies

We’ll work with you (including where ‘fire and re-hire’ is contemplated) to:

  • Identify when the collective redundancy consultation obligations thresholds are met and help you to manage this risk
  • Ensure you comply with collective redundancy consultation obligations, including staggered and/or overlapping processes (as well as coordinating advice across different jurisdictions)
  • Ensure that obligations owed to your employees’ representatives  are met, with bespoke training if needed
  • Manage redundancy sequencing, pooling, selection and subsequent individual consultation processes 
  • Implement redundancy severance proposals, including preparing and negotiating settlement agreements or COT3s
