With the number of whistleblowing claims on the rise since Ireland transposed the EU Whistleblowing Directive over two years ago, the area of protected disclosures remains high on the agenda for employers.

 

In this session, we will look at some of the common challenges we see employers face when dealing with protected disclosures including:

  • How to identify and manage a protected disclosure complaint and the importance of initial triaging; 
  • Determining whether something is a protected disclosure or a personal grievance;
  • How to deal with anonymous complaints and the issue of confidentiality; 
  • For international organisations, whether the use of centralised reporting channels will be sufficient; 
  • How to deal with protected disclosures raised by employees in an ongoing disciplinary or performance process.

We will also look at some of the recent caselaw on this topic and highlight our key takeaways for employers.  

This session will count towards 1 hour of General CPD.
